Welcome to trentontompkins.com. These Terms of Service ("Terms") govern your use of trentontompkins.com, the consultation request form, the project pages, and any related service operated by Trent Tompkins (collectively, the "Services"). By accessing or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

This Site is operated by AcquisitionInvest, LLC, a Wyoming limited liability company ("Operator," "we," "us," or "our"). References to "you" or "your" mean the individual or entity accessing the Services. See the Contact section for legal-notice details.

1. Who We Are

"Trent Tompkins," "I," "we," "us," or "our" refers to Trent Tompkins, an independent software developer and consultant based in Pittsburgh, Pennsylvania. You can reach me at the addresses listed under Contact below.

2. Eligibility

You must be at least 13 years old to submit forms or send messages through the Services. If you are under 18, you may only use the Services with the consent of a parent or legal guardian. The Services are not directed to children under 13, and we do not knowingly collect personal information from anyone under 13. See Privacy Policy.

3. Nature of the Services

trentontompkins.com is a personal portfolio and consultation-intake site. It does not host a customer account system, does not process payments, and does not sell goods through this domain. Engagements that begin from a consultation request are governed by a separate written agreement signed by both parties — not by these Terms.

4. Acceptable Use

You agree not to: (a) harass, threaten, or impersonate others when contacting us; (b) submit content that is unlawful, hateful, infringing, or that doxes another person; (c) attempt to probe, scan, or breach the security of the Services; (d) scrape, mirror, or re-host substantial portions of the Services without written permission; (e) use the Services to send spam, phishing, or malware.

5. Intellectual Property

The Trent Tompkins name, site design, project descriptions, photography, and underlying code are owned by Trent Tompkins and protected by copyright. Open-source projects listed on the site (Codex Black, FlatLine Debugger, Hosts File Script, git-symlinks) are governed by their individual repository licenses; nothing on this page overrides those licenses. Fair-use commentary, quotation, and review of site content are encouraged.

6. Text Messaging (SMS) Program

Trent Tompkins may send opt-in SMS messages in response to consultation requests and for follow-up on active engagements.

6.1 Consent & Opt-In

You only receive SMS messages from Trent Tompkins after you affirmatively opt in by (a) checking the "I agree to receive text updates" box on the consultation form; or (b) explicitly requesting SMS contact in an email or call. Your consent is not a condition of any purchase or engagement — you can request email-only contact at any time. We retain a record of when, how, and for what purpose you opted in.

6.2 Message Types & Frequency

Message frequency varies based on the consultation thread and engagement status. Typical frequency is no more than a handful of messages per active conversation. We do not send bulk promotional blasts.

6.3 Message & Data Rates

Msg & data rates may apply. Your wireless carrier may charge you for sending and receiving text messages. Trent Tompkins is not responsible for carrier charges.

6.4 HELP and STOP Keywords

For help at any time, reply HELP to any message from us, email trent@trentontompkins.com, or call (833) 319-3160.

To opt out at any time, reply STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any message from us. You will receive a single confirmation message and no further messages from that program.

6.5 No Sale or Sharing of Opt-In Data

Trent Tompkins does not sell, rent, lease, share, or otherwise disclose your SMS opt-in information (your phone number and the fact that you consented to receive text messages) to any third party for marketing or promotional purposes. SMS opt-in data is shared only with our messaging service provider as needed to deliver the messages you requested. See Privacy Policy for full data handling.

6.6 Supported Carriers

The SMS program is available on most major U.S. carriers, including AT&T, Verizon, T-Mobile, Sprint, U.S. Cellular, Boost, MetroPCS, Cricket, and Virgin Mobile. Carriers are not liable for delayed or undelivered messages.

7. Email Communications (CAN-SPAM)

Direct email correspondence with us is treated as one-to-one business correspondence and is not bulk marketing. If we ever introduce a mailing list, every marketing email will include a one-click unsubscribe link and our physical mailing address. You can ask us to stop emailing you at any time by replying with "unsubscribe" or emailing trent@trentontompkins.com.

8. Third-Party Links

The site links to other properties operated by Trent Tompkins (AcquisitionInvest, FullPriceExit, Practical Cryonics) and to third-party platforms (GitHub, npm, Amazon). Your use of those sites is governed by their own terms.

9. Disclaimers

The Services are provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Nothing on the site constitutes a guarantee of any specific business outcome.

10. Limitation of Liability

To the maximum extent permitted by law, Trent Tompkins's aggregate liability for any claim arising from the Services is limited to USD $100. We are not liable for indirect, incidental, consequential, or punitive damages.

11. Dispute Resolution

Please read this section carefully. It significantly affects your legal rights, including the right to file a lawsuit in court.

11.1 Binding Arbitration (Pre-Litigation Requirement)

ARBITRATION. Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or any transaction or interaction with the Operator shall first be resolved by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules in Butler County, Pennsylvania, in English, before a single neutral arbitrator. THIS IS A PRE-LITIGATION REQUIREMENT — you agree to arbitrate before filing any lawsuit. The arbitrator’s decision will be final and may be entered as a judgment in any court of competent jurisdiction.

11.2 Class Action Waiver

CLASS ACTION WAIVER. You and the Operator agree to resolve all disputes individually. You waive the right to participate in any class, collective, representative, or consolidated action — whether in arbitration or court. No arbitration may be consolidated without all parties’ written consent.

11.3 Court Venue (Injunctive Relief or Arbitration Unavailable)

COURT VENUE. If arbitration is unavailable, refused by the arbitration provider, or for claims seeking injunctive or equitable relief, the EXCLUSIVE venue is the Court of Common Pleas of Butler County, Pennsylvania and the U.S. District Court for the Western District of Pennsylvania. You consent to personal jurisdiction therein. No claims may be brought in any other forum.

11.4 Governing Law

GOVERNING LAW. These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-laws principles. The Federal Arbitration Act (9 U.S.C. § 1 et seq.) governs the interpretation and enforcement of the arbitration provision in Section 11.1.

11.5 Thirty-Day Arbitration Opt-Out

ARBITRATION OPT-OUT. You may opt out of the arbitration agreement in Section 11.1 within 30 days of your first acceptance of these Terms by emailing legal@trentontompkins.com with the subject line "ARBITRATION OPT-OUT" and including "trentontompkins.com" in the body. If you opt out, the court-venue clause in Section 11.3 governs all disputes; the rest of these Terms continue to apply.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced on this page with a new effective date.
